Virginia Legislation to End Adverse Possession

This is VERY exciting to see! In the news today, Virginia Senate Bill 67 stands to follow Washington State's Bill, HB 1479, to completely abolish adverse possession! Clearly, it is time for legislators to follow suit, listen to the people, and put an end to one of the most unfair and unnecessary laws of our time.

  1. The statute of limitations for adverse possession is 15 years. If your land sits idle for 15 years subject to another person’s adverse, continuous, actual, open and notorious possession, you deserve to have it taken. Unless you own as much land as Ted Turner, you should be able to take some action to protect your own property rights within 15 years.

  2. We need help in central Virginia. My family lost our 100 acres to a paper corp. by adverse possession. We are in the 21 day appeal process and have spent all of our money. If this case is not challenged any one can lose their property. The corp was awarded title because a survey encompassed our land in a larger 452acre survey. They were told of the error and took advantage of the law,they had no deeded text, we had deeds on record. Any help will be appreciated, Thank you

  3. To richreed, so your family , maybe an uncle,didn't have any real estate that they left to you? Say five years go by and you find out about it ,you check on it and bring the taxes up to date, what else can you do?The market is down ,the property is in new growth timber, so you pay the taxes and wait, only to find out that you don't own the property any more. A Corp has bulldozed your property,combined it with their property and put in a sewer plant, and you deserve this?Just asking!

  4. Our seasonal neighbor at the lake has mowed into our property. When his father built the house, he did not site the house correctly. The property line is about 3 feet from the back corner and 12 feet at the front corner of the house. We bought our lot 10 years ago. Last year they started mowing into our property. We tried to stop them and they sued us for an easement. Now they have pictures of a few family functions and are claiming they always used it and maintained it. It has cost us 15K to date to fight them, but we don't have the money to continue.
    What kind of law lets your neighbor claim your land!
